We are pleased that you are visiting our website. So that you feel secure and comfortable visiting our website, we wish to inform you below about the handling of your data. The following data protection regulations are intended to inform you about our handling of the collection, use and disclosure of personal data.

DER Touristik Deutschland GmbH is responsible for the data collection and processing.


HANDLING OF PERSONAL DATA

Protection of your privacy is very important to us. We have therefore fundamentally designed our web presence such that it can be used anonymously. Information that we receive and store during your visit to our website is used by us exclusively for internal purposes and to improve the design of the web pages. We only store the IP address transmitted by your web browser for a period of time in order to detect, limit and eliminate faults or errors (e.g. attacks on our servers). However, the storage ends after one month at the latest.  After expiry of this period we delete or anonymise the IP address. We use the IP address exclusively in a way that is strictly for the specific purpose of the aforementioned security. Further information about processing of the IP address can be found below under the point on “usage data”.


USAGE DATA / LOG FILES

When you visit our website, so-called usage data are stored temporarily as a log on our web server for statistical purposes, to improve the quality of our web pages.

This data set comprises:

  • The site from which the file was requested
  • The name of the file
  • The date and time of the request
  • The data volume transmitted
  • The access status
  • The description of the type of web browser used
  • The operating system
  • The IP address of the requesting computer (see above, anonymised in accordance with the aforementioned period)
     

LEGAL BASIS

DATA PROCESSING FOR CONTRACTUAL PERFORMANCE: TRAVEL BOOKING / BOOKING REQUEST


We process the following data in accordance with art. 6 par. 1 lit. b GDPR for the purpose of contractual performance:

  • Title, first name, surname (of all users and contact persons of customers / hotel)
  • Address data (of the associated customers and hotels)
  • e-mail address (of all users and contact persons of customers / hotel)
  • Telephone / Fax (on optional basis)


The purpose of the data collection is to ensure contact within the framework of the council negotiations between corporate customers and hotels in order to coordinate the negotiations.


This also includes the associated customer care.


During the contract negotiations we will send you e-mails to your specified e-mail address. In addition, you will receive further e-mails from us in connection with the contract negotiations. You can object to this sending at any time by sending an e-mail to datenschutz@dertouristik.com. Upon receipt of your objection, we will immediately discontinue the sending. If necessary, personal data are passed on to the companies that are involved with processing this contract, e.g. service providers such as hotel operators, airlines or financial institutions for payment processing.


If necessary, personal data will be passed on to the companies involved in the execution of this contract, e.g. service providers such as hoteliers.


The data required for the contractual performance are held in accordance with statutory retention periods (e.g. German fiscal code (Abgabenordnung – AO), German commercial code) and deleted after expiry of these periods.


DATA PROCESSING ON THE BASIS OF CONSENT

If you have issued separate consent, processing is performed accordingly on the basis of art. 6 par. 1 lit. a GDPR. Your consent can be revoked at any time without affecting the legality of the processing completed to date. If consent is revoked, we stop the corresponding data processing.

 

PARTICIPATION IN LOTTERIES, COMPETITIONS OR SIMILAR ACTIVITIES

On our website we offer from time to time the possibility to take part in competitions or contests and similar actions. Personal data such as e-mail address, name, address and, if necessary, other data necessary for the campaign may be collected and processed in order to carry out these campaigns. All personal data provided in the context of such a promotion will be used exclusively for the processing of the promotion, e.g. for the determination, notification or sending of the prize. The data will be deleted after the action is completed.


DATA PROCESSING TO FULFIL LEGAL OBLIGATIONS?

We process your data in order to be able to fulfil our legal obligations (e.g. from fiscal and commercial law). The data processing is performed on the basis of art. 6 par. 1 lit. c GDPR. The data are deleted after expiry of the required retention periods.


DATA PROCESSING TO PROTECT LEGITIMATE INTERESTS?

We process your data for our own marketing purposes (e.g. promotional approach, market analysis). The data processing is performed on the basis of art. 6 par. 1 lit. f GDPR. The data are deleted after expiry of the specified retention periods. You have the right to object to the data processing. You can find out more under the point below on “rights of the person concerned”.
 

DATA RECIPIENTS
 

We transmit your data to third parties (e.g. to service providers such as hotel operators) only if transmission authorisation under data protection regulations is in place. We can also transmit your data to external service providers (e.g. IT service providers, companies that destroy or archive data, print service providers), which – strictly subject to instructions – support us with the data processing as part of order processing.


Data processing here may also take place outside the EU or EEA. As an appropriate guarantee for the legality of these data transmissions, among other things we have formed EU standard contracts with the order processor in accordance with art. 46 par. 2 lit. c GDPR.


We will market your personal data neither to third parties nor otherwise.
 

REFERENCE TO A RIGHT OF OBJECTION AGAINST DIRECT ADVERTISING

We process your data for the purpose of direct advertising. You have your own right of objection to such processing, the exercise of which leads to the termination of processing for the purpose of direct marketing. Please address your objection to: datenschutz@dertouristik.com


WEBSITE ANALYSIS AND TRACKING

USE OF COOKIES

When visiting our website, it may be that information is saved on your computer in the form of cookies, for example to be able to identify preferences of visitors and accordingly design the website optimally. This helps us e.g. to make navigation easier and achieve a high level of user friendliness.

Cookies are text files that are stored on the hard drive of the user when our internet site is visited. They are harmless to your computer and cannot be seen by third parties. They allow information to be held over a certain period and the user’s computer to be identified.

USER LOGIN

You will receive a user login on our website during contract negotiations. This login gives you the opportunity to provide information about your negotiations.

For the registration, a user name and password must be set, and an e-mail address must be specified.

In the customer account, you can maintain your personal data and and keep them up-to-date for bookings.

The following personal data is recorded here:

  • Salutation
  • Title
  • First name
  • Surname
  • Email address


Furthermore contact information such as telephone and fax numbers of the associated company.

The collection of this data serves to establish contact for potential contract partners on the part of hotel and corporate customers for contract and rate negotiations.


CONTACT

On our website there is also the possibility to get in contact with us on various topics.

Depending on the background of the contact, different data are requested. Personal data such as title, first name, surname and e-mail address are usually mandatory for the purpose of establishing contact and personal address. Should you require a callback or appointment request, additional data such as telephone number can also be requested.
 

DATA SECURITY

To protect your data from undesired access, we use an encryption method on our pages. Your data will then be transmitted from your computer to our server and vice versa via the Internet using TLS 1.0, TLS 1.1 or TLS 1.3 encryption. You can recognize this by the fact that the lock symbol on the status bar of your browser is closed and the address line starts with https:// .
 

RIGHTS OF THE PERSON CONCERNED

People concerned have the right to information from the person responsible about the personal data concerning them and to correction of inaccurate data or to deletion if one of the reasons specified in art. 17 GDPR applies, e.g. if the data are no longer required for the purposes pursued. The right also exists to limit the processing if one of the conditions specified in art. 18 GDPR applies, and the right to data portability in cases of art. 20 GDPR. If data are collected on the basis of art. 6 par. 1 lit. e or lit. f, the person concerned has the right to object to processing at any time for reasons arising from the specific situation.
We will then no longer process the personal data unless compelling legitimate reasons for the data processing exist verifiably, which outweigh the interests, rights and freedoms of the person concerned or if the processing serves to assert, exercise or defend legal claims.


RIGHT TO APPEAL TO A REGULATORY AUTHORITY

Every person concerned has the right to appeal to a regulatory authority if the person is of the opinion that the processing of the data concerning the same infringes data protection regulations. The right to appeal can be exercised specifically to a regulatory authority in the member state of the residence of the person concerned or the place of the suspected infringement.
